Terms governing your use of Gwirian.
The Service is operated by Frédéric Rocher, domiciled in Couëron, France.
Last updated: See above. By using Gwirian (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1. Acceptance
By accessing or using the Service, you agree to be bound by these Terms and any additional policies referenced here. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of the Service
Gwirian is a test scenario management platform for QA teams. The Service may be used in a hosted form (at app.gwirian.com or other domains we designate) or self-hosted by you. These Terms apply to use of the hosted Service; self-hosted use is governed by the applicable open-source license.
3. Account and Use
You must provide accurate information when creating an account. You are responsible for keeping your credentials secure and for all activity under your account. You will use the Service only in compliance with applicable laws and will not misuse, abuse, or attempt to gain unauthorized access to the Service or others’ data.
4. Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation.
- Infringe others’ intellectual property or rights.
- Transmit malware or harmful code.
- Overload or disrupt the Service or its infrastructure.
- Scrape or automate access in ways not permitted by us.
We may suspend or terminate access if we reasonably believe you have violated these Terms.
5. Intellectual Property
The Service (including its design, code, and content we provide) is owned by Frédéric Rocher or its licensors. You retain ownership of the data you upload. You grant us the rights necessary to operate the Service (e.g. to store, process, and display your data as part of the Service).
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We process data as described there and as needed to provide and improve the Service.
7. Disclaimers
The Service is provided “as is.” We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose. We disclaim all warranties to the fullest extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, Frédéric Rocher shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use, arising from or related to the Service or these Terms. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or one hundred euros if you paid nothing).
9. Indemnification
You agree to indemnify and hold harmless Frédéric Rocher from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
10. Changes to the Terms
We may update these Terms from time to time. We will post the updated Terms on this page and, for material changes, we may notify you by email or through the Service. Continued use after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or for operational or legal reasons, with notice where practicable.
12. General
- Governing law and jurisdiction: The laws of France. The courts of Nantes shall have exclusive jurisdiction.
- Entire agreement: These Terms (together with the Privacy Policy and any order or plan terms) constitute the entire agreement between you and Frédéric Rocher regarding the Service.
- Severability: If any provision is held invalid, the rest of the Terms remain in effect.
